I did a small test locally and from a webserver; just by selecting the swf, right-click and choosing 'Order - Send Backward' (etc) you can put one layer behind another.
One thing more, I remember from older Flash players they were allways on top of everything. I think it was player 6 or 7 when it was first possible to puit layers over an SWF.
You might check which Flash version and player you use ...
